Acceptance of these Terms
These Terms of Service (“Terms”) govern your access to and use of theboard.consulting (the “Site”), operated by THE BOARD (“we”, “us”, “our”, or the “Firm”).
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Site.
Use of the Site
The Site is provided for general informational purposes and to enable you to contact us, request advisory services, or subscribe to our public content. You agree to use the Site only for lawful purposes and in accordance with these Terms.
You agree not to:
- Use the Site in any way that violates applicable law or regulation
- Interfere with or disrupt the Site, the servers on which it is hosted, or any networks connected to it
- Attempt to gain unauthorised access to any part of the Site, its systems, or its data
- Use the Site to transmit any material that is unlawful, defamatory, fraudulent, or otherwise objectionable
- Scrape, harvest, or copy substantial portions of the Site by automated means without our prior written consent
- Misrepresent your identity or affiliation when submitting forms or otherwise communicating with us
No professional advice via the Site
Content published on the Site — including case studies, partner commentary, market intelligence, frameworks, and any materials available in the Intelligence Vault — is provided for general informational purposes only.
Site content does not constitute legal, financial, tax, investment, regulatory, or any other professional advice and should not be relied upon as such. Engagement-specific advice is provided only under a separately signed engagement letter governed by our Consulting Services Agreement.
Intellectual property
The Site and all of its content — including text, graphics, logos, marks, images, audio, video, software, frameworks, articles, and case studies — are owned by or licensed to the Firm and are protected by copyright, trademark, and other intellectual property laws.
You may view, download, and print Site content for your personal, non-commercial reference, provided you preserve all copyright and other proprietary notices. Any other use — including reproduction, modification, distribution, public display, performance, republication, or commercial exploitation — requires our prior written consent.
“THE BOARD” and any associated logos and marks are trademarks of the Firm. You may not use them without prior written permission.
Your submissions
When you submit information, files, or other content to the Site (collectively, “Submissions”) — for example, through our contact, Strategic Audit, or Boardroom Q&A forms — you represent that:
- You have the right to share the Submission and grant the licences described below
- Your Submission does not violate the rights of any third party or any applicable law
- The information you provide is accurate to the best of your knowledge
You grant the Firm a limited, non-exclusive, royalty-free, worldwide licence to use your Submission solely as necessary to respond to your enquiry, deliver the services you have requested, and operate the Site. We treat Submissions in accordance with our Privacy Policy.
Third-party links and services
The Site may contain links to third-party websites or services that are not owned or controlled by us. We do not endorse, and are not responsible for, the content, policies, or practices of any third party. Your use of any third-party site is subject to that site’s own terms and privacy policy.
Disclaimers
The Site and all content on it are provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by applicable law, we disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components. Your use of the Site is at your own risk.
Limitation of liability
To the maximum extent permitted by applicable law, the Firm and its partners, members, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of, or inability to use, the Site — including without limitation any loss of profits, revenue, data, or business opportunities — whether in contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages. Our aggregate liability in connection with the Site will not exceed one hundred United States Dollars (USD 100), or the minimum amount permitted by applicable law if higher.
Indemnification
You agree to defend, indemnify, and hold harmless the Firm and its partners, members, employees, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Site, your Submissions, or your violation of these Terms.
Termination and suspension
We may suspend or terminate your access to the Site at any time, without notice, for any reason — including suspected violation of these Terms. Sections of these Terms that by their nature should survive termination shall do so.
Changes to these Terms
We may revise these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
Governing law and jurisdiction
These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to its conflict of laws principles. The courts of Dubai, UAE have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.
Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
These Terms, together with our Privacy Policy and any other agreement we have with you in writing, constitute the entire agreement between you and us with respect to the Site, and supersede any prior agreements on the same subject matter.
